General terms and conditions

General

Label C Boutique is located in Amsterdam. Chamber of Commerce number  email address: sales@labelc.nl (“Label C Boutique” or “we”).

Label C Boutique sells clothing, shoes, jewelry, and accessories (the “Products”) through its webshop www.labelc-boutique.com (or any other website operated by us, together the “Website”) and through physical stores.

These general terms and conditions (including all documents referred to herein and any other special conditions confirmed by us in writing, collectively the “Terms”) apply to all offers made by Label C Boutique and to all agreements between Label C Boutique and the purchaser (“Purchaser” or “you”).

Please read these Terms carefully before placing an order for Products on the Website. By placing an order, you automatically agree to and are bound by these Terms. If you have any questions, please contact our Customer Service at sales@labelc.nl before placing an order.

Orders

All offers made by Label C Boutique on the Website or in its stores are non-binding, and Label C Boutique may amend or withdraw them at any time.

An agreement is concluded once Label C Boutique has confirmed your order in writing (via email). If you do not receive a confirmation within 24 hours of placing your order, please contact our Customer Service.

Label C Boutique may cancel a confirmed order before it is shipped, for example, if payment authorization cannot be obtained, if Label C Boutique is still owed money by you, if the price is incorrect (in which case you may still order the Product at the correct price), if shipping restrictions apply to a particular Product, if the Product is out of stock, or if it does not meet our quality standards and is withdrawn. Label C Boutique will notify you by email. If we are unable to contact you, the order will be automatically canceled.

Label C Boutique is not obligated to sell the Products at the listed price if the Purchaser should reasonably understand that the price is incorrect or contains an obvious error.

If Products are no longer available, whether or not after we have confirmed your order, we will notify you. You may choose to order a different Product or cancel the order. Any payments made will be refunded upon cancellation.

By placing an order, you confirm that the information you provide is complete and accurate, and that you are 16 years or older, or have permission from your parent/guardian.

If the Purchaser accidentally receives more Products than ordered, they must notify Label C Boutique by email and return the extra Products at Label C Boutique’s expense.

Prices and Payment

All prices are in Euros and include 21% VAT.

Payment is made through the payment process on the Website. Klarna collects the payment from the Purchaser. If the Purchaser pays late to Klarna, any additional fees charged by Klarna are the responsibility of the Purchaser. If the Purchaser returns a Product to Label C Boutique, they must first pay Klarna. Upon acceptance of the returned Product by Label C Boutique, the amount paid will be refunded.

To use Klarna, you must be at least 18 years old. If the Purchaser is under 18, parental or guardian consent is required.

All credit and debit cardholders are subject to validation checks and authorization by the card issuer. If the card issuer refuses payment, Label C Boutique may refuse your order.

Any shipping costs are listed on the Website and are the responsibility of the Purchaser.

Delivery, Defects, and Liability

Label C Boutique delivers the Products to the shipping or delivery address provided by you when placing the order. Products are considered delivered when accepted by or on behalf of you at the delivery address. If we are unable to deliver the Products to you despite reasonable efforts and cannot contact you, we will cancel the order.

Products picked up at a Label C Boutique store are considered delivered at the moment you collect them.

We aim to deliver the Products within 3–5 working days after acceptance of the order. Delivery times are estimates and not guaranteed. Label C Boutique may deliver orders in parts.

If a delivery is signed for, this means the Product has been delivered to the Purchaser. If the Purchaser still claims non-receipt, the burden of proof lies with the Purchaser.

We are legally required to deliver Products in conformity with the agreement. You must inspect the Products for defects as soon as possible after delivery and notify us, preferably within seven (7) days, so we can, if necessary, make a claim against the carrier. You must notify us of any defects within thirty (30) days of receiving the Product and send photos of the defect(s). Defective Products can be returned as described in Article 5.

We do our best to depict the Products as accurately as possible on the Website. However, we cannot guarantee that the images are an exact representation, due to variations in monitors or screens. All specifications, drawings, and measurements are approximations.

Label C Boutique’s liability is limited to the obligations stated in these Terms and product liability. Any other liability is expressly excluded unless the damage results from intent or gross negligence by Label C Boutique.

Cancellation and Return Policy

You may return Products ordered via the Website within thirty (30) days of receipt, for any reason. You must request a return form via the Website and return the Products by mail at your own expense and risk within fourteen (14) days of the return request. Online orders cannot be returned in-store.

During the 30-day period, you must handle the Product with care and only unpack or try it on to the extent necessary to determine whether you wish to keep it. Returns must be in original packaging, with tags, and all accompanying materials. The Product must be unworn and in original condition. If we receive the Product damaged, you are liable for the damage, and we will not refund the returned Product. If your order included a free gift, it must be returned along with the Product.

We are not responsible for and do not accept liability for Products you mistakenly or incorrectly return to us. These Products will not be stored or returned to you.

After receiving your return request, we will refund the purchase price and the initial shipping costs (if applicable) as soon as possible, but no later than fourteen (14) days.

You can purchase a return shipping label through our Website. The Purchaser is responsible for the return shipment and bears the risk until the Product is delivered to Label C Boutique. If the return is lost, the Purchaser must resolve this with the shipping provider.

Force Majeure

Label C Boutique is not liable for any failure or delay in performance due to force majeure. Force majeure includes any circumstance beyond Label C Boutique’s control, such as strikes, industrial disputes, civil disturbances, acts of third parties, wars, riots, blockades, lightning, fire, storms, explosions, epidemics or pandemics and related regulations or government measures, failure to obtain permits, or compliance with any law, regulation, or directive (even if later deemed invalid).

In the event of force majeure, Label C Boutique will inform you as soon as reasonably possible. Both Label C Boutique and you may terminate the agreement if the force majeure situation lasts longer than twenty-one (21) days. In such case, Label C Boutique will refund all payments made for Products not yet delivered.

Account, Personal Data, and Privacy

To place an order, you may need to create an account with Label C Boutique. To open an account, you must provide certain personal information. You are responsible for the security and proper use of your password and must keep it confidential. If you suspect misuse of your account, contact our Customer Service immediately.

Label C Boutique processes your data in accordance with its Privacy Policy. Please read the Privacy Policy carefully. By placing an order or using the Website, you consent to the storage and processing of your data and confirm that the information provided is accurate and complete.

By accepting these Terms, you give us permission to send newsletters and promotional offers to your email address. You can unsubscribe at any time via the link in the email. Label C Boutique may also stop sending newsletters or offers at its own discretion.

Intellectual Property Rights

All intellectual property rights in the Website, its contents (including text, design, layout, images, and videos), the Products, and the trademarks and trade names of Label C Boutique are owned by Label C Boutique.

You may use the Website and its content for your personal use only (including printing or digitally storing for future reference). Any other use (such as copying, redistributing, storing content on another website, framing, or (deep) linking to another website) is not allowed without our express written permission.

Termination

Either Label C Boutique or you may terminate the agreement (including rescission) if:

  • a suspension of payment or bankruptcy has been applied for against the other party;

  • the other party has been granted suspension of payment or declared bankrupt;

  • the Debt Restructuring Natural Persons Act applies to you;

  • the other party fails to fulfill its obligations and does not remedy the breach within fourteen (14) days after written notice.

Miscellaneous provisions

Label C Boutique may amend these Terms at any time. By placing an order, you agree that the most recent version of these Terms applies.

Any deviation from the terms of the agreement (including these Terms) must be made in writing and signed by both parties.

References to ‘in writing’ also include email, unless stated otherwise.

If any provision in these Terms is invalid or unenforceable, it will be replaced by a valid provision, and the remaining provisions will remain in effect.

Failure to enforce any part of these Terms does not constitute a waiver of rights. A waiver must always be explicit and in writing.

Any (general) terms and conditions from you and/or a third party are expressly excluded and do not apply to the agreement between you and Label C Boutique.
